New Immigration Rights for Same-Sex Couples

In a pair of 5-4 rulings on the final day of the Supreme Court's term, the justices held that Section 3 of the Defense of Marriage Act (DOMA) violated the equal protection clause of the Fifth Amendment to the United States Constitution. Read one of the cases here: U.S. v. Windsor

Almost immediately thereafter, the Department of Homeland Security issued a statement to the effect that individuals with legally valid gay marriages are immediately eligible to file a Form I - 130; Petition for Alien Relative, and assist their spouse to immigrate to the United States. In many situations, same-sex couples who were married in a state that recognizes gay marriages, but who now live in a state that does not, may qualify for immigration benefits. However, each case is different and must be based on the fact specific circumstances of the marriage and case law.
